DAVIS COUNTY -- A man accused of trying to meet a Utah teenager for sex will not face charges because of his bad health.

Reinaldo Canton is accused of traveling from New Mexico to the Layton Hills Mall to meet a 15-year-old girl he met online. That "girl" turned out to be an undercover cop.

Now Canton, a retired air force major, has come down with some serious heart problems, and prosecutors are dropping the charges.

Defense attorneys argued it would amount to cruel and unusual punishment to continue with court proceedings and bringing the case forward would be a death warrant.

The prosecutors who dropped the case aren't commenting except to say they can re-file if things change.
