OREM -- Dell Schanze is heading to trial after a run in with police in Saratoga Springs.

The court documents say Schanze was charged with reckless driving and carrying a concealed weapon after being pulled over for swerving his car back and forth along Redwood Road last Aug.18.

The officer allegedly found a loaded gun in a fanny pack Schanze was wearing. His concealed-carry permit had expired.

In court Friday, Schanze declined any deals with prosecutors, saying he would rather go to trial.

He said, "Any government that charges somebody like me with a crime, obviously has a problem. Cause I'm one of the nicest guys there are! I'm the exact model of an American; someone who stands up for what they believe in."

Outside court Schanze said the prosecutors didn't have a case because he had a valid concealed carry permit and he was driving under the speed limit and never crossed out of his lane.

"They have no case. Of course I'm ready. I mean, they want to waste everybody's time, that's fine, you know. And we'll roll the dice and see whatever they want to make up, but if they would like to follow the law, that would be great!"

Schanze also faces three counts of child seat belt violations.

Schanze has pleaded not guilty to all counts. He says he wasn't carrying a weapon and that he was rocking the car back and forth to entertain the kids and never left his traffic lane.

He also says he, his wife and four children were all wearing seat belts.

Schanze is using a court-appointed attorney because he said he's out of money.

The trial is scheduled in June.
