Shelley Osterloh ReportingThe man accused of scalding his own child is in police custody. The one-year old baby is recovering from third degree burns on the lower half of his body.

His mother told me this afternoon, he is doing well, but still sedated because he is in so much pain. Last Wednesday she returned home to find her house empty; the baby's father -- who had not been part of their lives till now -- was supposed to be caring for Malachi.

When the father returned he told her he had taken the baby to the playground. Soon after he left, she discovered Malachi's burns. Now he's in the ICU at the University Hospital

Genoria Marsalis, Malachi's Mother: "Waking up crying and coming in my room jumping in my bed, that's what I miss."

Police searched for the baby's father, Eric Jones, and just yesterday spotted his car and arrested him. He is saying nothing about what happened to little Malachi and that troubles his mother.

Genoria Marsalis, Malachi's Mother: "I'm just glad that they found him. I still want to know why he did that to my son. I want to know why he's not saying nothing, he wont talk or say nothing."

Jones faces possible felony child abuse charges.

In the meantime, Genoria says she's had an outpouring of support from friends and her church members. There is a fund set up at Wells Fargo to help Malachi Marsalis and his family.
