A man came to the rescue of his friend after a mix-up between Utah Highway Patrol and the Davis County Attorney's Office.

19-year-old Jordan James Creswell was supposed to face a negligent homicide charge after his motorcycle smashed into the back of a pickup truck on I-15 Aug. 1, killing his friend on the back of the motorcycle.

However the friend, Bryant Mavretic, is alive and well. He spent only 4 days in the hospital.

Mavretic tells the Standard Examiner he thought the news of his death was funny.

The Davis County Attorney will drop the charge. Deputy Davis County Attorney Steve Major told the Standard Examiner the error was the result of a miscommunication between his office and UHP investigators.

Creswell still faces a misdemeanor alcohol charge.
