OGDEN — An Ogden man has been sentenced to four years of probation for engaging in unlawful sexual conduct with a girl.
Jose Rodriguez Cid, 21, on Tuesday received suspended prison terms of one to 15 years for obstruction of justice, a second-degree felony, and zero to five years for unlawful sexual conduct with a 16- or 17-year old, a third-degree felony. Judge Craig Hall granted Rodriguez credit for 139 days served in jail and placed him on probation for four years.
As part of a plea deal, prosecutors dismissed a count of aggravated kidnapping, a first-degree felony. Rodriguez admitted to having sex with a 14-year-old girl in November of last year, which led to the unlawful sexual conduct charge, and hampering the investigation into his case by discarding a cellphone, which led to the obstruction charge.
According to original charging documents, the girl was a runaway and not supposed to be with Rodriguez. The victim's father reported the girl as a runaway to police and showed authorities text messages on his phone to the girl asking her to come home.
"Jose admitted post-Miranda that he had driven the victim from her home to Ogden against her father's wishes and admitted to throwing his phone out of the window after factory resetting his phone," charging documents state.
