OGDEN — A third suspected gunman has been charged in the Aug. 31 shooting incident at a street racing competition in rural Weber County that left one man dead and two others with gunshot wounds.
The 15-year-old boy is charged in Ogden's 2nd District Juvenile Court with murder, a first-degree felony, in the incident for allegedly firing a weapon, along with two other suspects, at the clandestine gathering on 9350 West near 900 South. He's also charged with possession of a firearm by a restricted person and obstruction of justice, second-degree felonies, as well as felony discharge of a firearm, a third-degree felony.
Antonio Ruiz, 17, and Michael Robles Gaisbauer, 18, are also charged with murder, among other crimes, in the incident. Ruiz is being charged as an adult, while KSL.com isn't naming the 15-year-old suspect, who is still being charged as a juvenile, though Weber County prosecutors are seeking to try him as an adult.
Charging papers for the 15-year-old, filed in court on Oct. 16 and supplied to KSL.com on Thursday, reference the chaotic scene at the street racing competition, which drew a large crowd. The charges say an apparent argument between two females allegedly spurred the 15-year-old boy, Ruiz and Gaisbauer to fire their guns, injuring the three victims.
Ogden resident Jesus Cuadras Garcia, 22, was struck in the head by a bullet and later died; two others, the man's young daughter and another adult male, were hit by gunfire but survived.
Charges say the 15-year-old told investigators "that he was there that night and was arguing with one of the two females fighting when shots started to be fired. He then diagrammed himself going to the area where 20 9mm brass casings were recovered." Around 30 bullet casings from multiple calibers of weapons were found at the scene, according to authorities.
The 15-year-old denied firing a weapon but said he "threw his handgun into the woods" after the incident, according to charges. Police say two other witnesses told them they saw the 15-year-old shooting a weapon.
The 15-year-old was previously adjudicated in juvenile court for aggravated assault for firing a gun at another juvenile in Ogden in 2023, according to the juvenile court charges.
Gaisbauer, of Perry, Box Elder County, and Ruiz, of Ogden, are scheduled to next appear in court in their cases on Nov. 18. Gaisbauer is being held in the Weber County Jail, and Ruiz is being held in the Salt Lake Valley Youth Center in Salt Lake County, according to court papers.
