OGDEN — The ex-girlfriend of a man targeted in a 2021 assault in Ogden was sentenced this week to up to five years imprisonment for conspiracy to commit aggravated assault.
Nickie Kay Holder, now 45, was sentenced Tuesday by 2nd District Court Judge Joseph Bean in connection with a plan to lure Dustin Smith to an Ogden apartment to assault him. Holder schemed with Jonathan Brewer to carry out the plan, and Brewer, 30, was shot and killed by Smith during the resulting altercation when he arrived at the apartment at 240 N. 180 East. Police were called to the scene of the incident shortly after midnight on Oct. 2, 2021.
"During the course of the investigation, it was discovered that Holder and Brewer were working together to lure Smith to the apartment and assault him. A warrant was obtained to search Holder's phone. It was discovered she and Smith had been in a past relationship, which had soured," reads the narrative of events in Holder's July 31 plea agreement. Holder's home address was listed as Washington Terrace in the charging documents in 2021.
Smith, from Midvale, fled but was later charged in the matter and ultimately pleaded guilty to possession of a dangerous weapon and obstruction of justice. He was sentenced in 2022 to one to 15 years imprisonment on the weapons charge and up to five years imprisonment on the obstruction charge, sentences that were to run concurrently.
