CLINTON — A Clinton man was arrested Sunday night after police say he shot a man in the abdomen and ear.
Police responded to reports of a gunshot wound near 1076 N. 750 West in Clinton, about 4:50 p.m. Officers found the victim at a neighbor's home "with a gunshot wound in the abdomen and the ear," according to a police booking affidavit.
Police say they found Toby Anthony Rodriguez, 34, carrying a shotgun at the same address. He was taken into custody and interviewed at the Clinton Police Department, where he "admitted to a detective that he had consumed a large amount of marijuana and alcohol," the affidavit states. Police reported finding a pipe on the ground where the man was arrested.
Rodriguez told police he and the victim had been looking at weapons in his home, including a long rifle, a shotgun and a handgun.
"The suspect admitted to the detective that he had intentionally tried to kill the victim by shooting him three times with the handgun," the arrest report states. The victim was struck in the abdomen — "causing serious bodily injury" — and in the ear. Police say another round was fired in the direction of the victim, and shell casings were found in the home that match the firearm described.
The victim was interviewed after undergoing surgery at McKay-Dee Hospital in Ogden.
A GoFundMe* account was set up to help the victim cover medical bills. The page identifies him as Marco Rodriguez, and says he underwent a second surgery Tuesday due to internal bleeding, and he is "awake and alert."
Toby Rodriguez was booked into Davis County Jail for investigation of attempted murder, felony discharge of a firearm, purchase, transmission, possession or use of a firearm by a restricted person and use or possession of drug paraphernalia.
