Convicted sex offender charged with sexually assaulting another child

SALT LAKE CITY — A man who spent 15 years in the Utah State Prison for having unlawful sex with children is facing new allegations of sexually abusing a child.

Michael John Dylan Kirth, 38, of Salt Lake City, was charged Tuesday in 3rd District Court with rape of a child and four counts of aggravated sexual abuse of a child, first-degree felonies; and being a sex offender in the presence of a child, a class A misdemeanor.

Kirth is accused of sexually assaulting a girl under the age of 12 in his apartment in October. During the assault, the girl told Kirth to stop "and he told her he would not stop until he was done and that if she did anything else to make him mad, he would duct tape her mouth shut," according to charging documents, "and that if she followed instructions, she would make it out of there unharmed."

In 2007, Kirth was convicted of multiple counts of unlawful sexual activity with a minor and sex abuse of a child in several cases. He was sentenced to prison and granted parole in September of 2022. As part of the conditions of his parole, Kirth is not allowed to have contact with anyone under the age of 18.

Kirth was returned to police custody in October after a concerned citizen saw a child go unsupervised into Kirth's apartment — whom the citizen knew was a registered sex offender — and called police.
