OGDEN — Two Roy men are being held in jail without bail after they were accused of taking part in a shootout after a fight earlier this month.

Raymond Garcia, 19, and Izack Martinez, 20, were charged last week with three counts of discharging a firearm and obstructing justice, third-degree felonies. Garcia is charged with four counts of possession or use of a firearm by a restricted person while Martinez is charged with three counts of possession or use of a firearm by a restricted person, all of which are third-degree felonies.

Around 2:30 a.m. on March 6, Roy police were dispatched to a home along 2325 West after a shooting was reported to 911 dispatchers. Gunshots can allegedly be heard on the 911 call, and the caller mentions Raymond Garcia, according to charging documents.

Police arrived on scene and were told by witnesses that multiple shots were fired after a verbal altercation evolved into a physical fight. Investigators also say that a green car fled the scene and crashed nearby before hitting a mailbox and continuing to drive away, the charges state. The car had also lost a window at some point while driving away. Police say witnesses told them that Garcia was involved in the shooting.

In a separate call, police were told that a green car that matched the description of the fleeing car and had a missing driver's side window was parked in Roy roughly two miles away. A gun was "in plain sight on the driver's seat," according to the charges, and was registered to a family member of Garcia. The car was also found in the area where both Garcia and Martinez live, police say.

Police were later given a video that showed the green car being parked, followed by several people getting out of the vehicle. The video showed "several people screaming," before multiple people get into another car and leave the area, the charges say. Police later learned the second car then drove to Ogden Regional Medical Center with one person who was treated for a gunshot wound to their side.

Police served a search warrant on March 6 at the house where the two men live and reported finding three guns, ammunition, magazines, spent shell casings, bloody clothing and other items. The guns recovered from the home were found in the air vents in different areas of the home, according to the charges.

On March 8, Garcia and Martinez contacted police and requested to meet with investigators at the Roy Police Department. Garcia allegedly told police that he and another man got into a fight, and the other man had a gun. He and the other man started fighting over the gun before it went off, the charges state.

Garcia told police he then ran out of the house and started to drive away when someone in a group of people standing in a driveway began shooting at his car. Moments later, the car crashed and hit a mailbox. Garcia said that is when Martinez began to shoot back, the court documents say. Garcia allegedly said that there were multiple people in the car, and when they arrived at the home, the guns were moved into the vents.

Martinez told police that he fired three shots out of the car toward those shooting at him in the driveway, according to the charges. He allegedly said that he only had three bullets, and he would have kept shooting if he had more rounds.

Investigators say both have prior felony convictions, meaning they are both barred from being able to possess guns. However, a search of Utah's court records did not show any prior felony cases filed against either of the two.

Both are being held without bail at the Weber County Jail.
