(KSL News) -- A Utah County woman accused of identity theft wants a new judge because the one currently trying her case sentenced her brother for murder.
Nicki Lynn Warner is charged with using checks belonging to her dead sister-in-law, Sharee Hatch. At a hearing yesterday Warner said she did not want her case heard by Judge Fred Howard because he sentenced her brother to prison for Hatch's murder.
Robert Steven Hatch will not be eligible for parole until 2027.
Warner has been instructed to work out the conflict with her attorney.
