SALT LAKE CITY (AP) -- A judge has removed two Salt Lake City police officers and the city from an excessive-force lawsuit filed by a war veteran who said police gave him a serious head injury during an arrest in 2006.
But U.S. District Judge Bruce Jenkins on Thursday did not remove officer Bryce Curdie from the lawsuit and did not rule on the merits of the claim.
Miles Lund, 74, was arrested at Liberty Park in November 2006 after he got into a dispute with someone, who said Lund pointed a gun.
The lawsuit says Lund told officers could not place his hands above his head due to a disability. The suit says Curdie then rushed at Lund and tackled him, grabbing him around the neck.
No weapon was ever found and no charges were filed against Lund, who is seeking $10 million in damages.
