(KSL News) A charge of child abuse homicide has been dismissed against an Orem woman because the judge says there is no evidence she caused the death of her alleged victim.

The charge was filed against Candice Collard following the death of 14-year-old Jess Micade Horrocks in April. Collard was called to pick up the heavily intoxicated boy at a Vernal restaurant when his friends became concerned. She took him home instead of to a hospital.

He died of alcohol poisoning.

The Deseret News reports that lawyers for Collard argued that the boy's blood alcohol level was high enough that even going to the hospital would not have guaranteed his survival.
