The family of a man killed in the Crandall Canyon mine disaster has made a claim in court saying they're getting short-changed on their workers compensation benefits.

Juan Carlos Payan was one of the six coal miners killed by a cave-in at Crandall Canyon mine last year.

With his paycheck, Payan was supporting his disabled father, mother and two young sisters in Mexico, according to his parents.

The parents want full benefits of about $2,400 a month - five times the amount offered by Genwal Resources Inc. and its insurer over six years.

The companies say Payan had two other siblings working in Utah to help support the family and that he wasn't the sole benefactor.

An administrative law judge presided over a hearing Wednesday. The judge said her decision was two or three months away.
