PROVO, Utah (AP) — A new trial for a Utah man whose murder conviction was overturned in his wife's death will be delayed after an unsuccessful push to remove the judge.

[The Daily Herald reports](< http://bit.ly/2e0m5gv>) the trial for 34-year-old Conrad Truman was rescheduled on Monday at his lawyer's request. His new trial is now set to begin Feb. 1 and run through the month.

Truman had argued that comments from Judge Samuel McVey showed he is biased against drinkers. The district's presiding judge disagreed, ruling those and other comments cited by his lawyers were taken out of context.

McVey overturned the 2014 guilty verdict after deciding inaccurate measurements of the Truman house wrongly undermined the defense theory that Heidy Truman fatally shot herself.

Prosecutors said the mistake was a harmless error and they have other evidence against him.
