Payson woman charged with automobile homicide in crash that killed 8-year-old boy

PAYSON — A Payson woman has been charged with automobile homicide in connection with the auto-pedestrian crash that killed an 8-year-old boy earlier this month.

In addition to that second-degree felony offense, 37-year-old Tabatha Magoon was charged Monday in 4th District Court with possession or use of a controlled substance, a class A misdemeanor.

Investigators say Magoon was driving under the influence of methamphetamine and other substances March 20 when she took a wide right turn onto 1000 South in Payson. Magoon hit 8-year-old Kaydon Sillitoe, who was riding his skateboard, pinning him underneath the woman's SUV, according to Payson police.

Kaydon, of Payson, suffered severe head trauma and later died later at Mountain View Hospital. He celebrated his eighth birthday one day earlier, his family said.

Charges say Magoon admitted to smoking meth the day of the crash.

"Blood results are pending, but a quick urine … test showed the presence of amphetamines, opiates, methamphetamine, and oxycodone in (Magoon's) urine," charging documents state.

Another test, known as a drug recognition examination, was conducted on Magoon several hours after the crash and turned up indicators that "a controlled substance … could have affected (her) ability to safely operate her vehicle," the charges state.

Police have also said Magoon's wide turn placed her vehicle on the wrong side of the road at the time of impact.

On March 23, Magoon was charged with theft, a class B misdemeanor, for an alleged March 19 incident. Prior to this month, her criminal history in Utah consisted only of minor traffic violations, according to a search of court records.

Magoon has posted $10,000 cash only bail and is currently out of custody. Her initial hearing in 4th District is set for Tuesday.
