SALT LAKE CITY — After a federal judge summarily rejected a request to postpone the criminal trial for Jeremy Johnson and three associates this week, his lawyer is making another run at putting it off.
Defense attorney Rebecca Skordas cited new evidence and overlap of Johnson's civil trial in Las Vegas as reason for delaying the Feb. 1 trial date, according to a court filing Thursday. Johnson, Ryan Riddle, Scott Leavitt and Bryce Payne face dozens of fraud charges related to Johnson's Internet marketing company, iWorks.
Skordas said Johnson's defense is seriously compromised by missing emails from the four defendants to parties outside iWorks. Attempts to recover the email are being made, and lawyers need time to review the new data if it becomes available, she argued.
On Monday, U.S. District Judge David Nuffer rejected Payne's motion for a delay, saying it wastes time lawyers could be using to prepare for trial.
