(KSL News) Statements made by a man accused of murder in Beaver County have been thrown out by the judge in the case.
Lawyers for Mark Elden Erickson argued that the statements were made during a police interview that was conducted after Erickson requested to speak to a lawyer. The Deseret News reports the judge agreed it violated Erickson's Miranda rights.
Prosecutors say they're not worried about proving their case without the statements. They say a number of witnesses were present in the restaurant where Erickson shot and killed Timothy McEnaney last year.
