Woman pleads to homicide charge in Carbon County overdose death

PRICE — A Carbon County woman has pleaded guilty to negligent homicide for her role in the overdose death of a Price man.

Amee Lavon Averett also pleaded guilty Monday in 7th District Court to distribution of a controlled substance, court records show.

Averett, Jason Jared Jaimez and Shelbi Elizabeth Mower all engaged in reckless conduct that caused the Dec. 23. 2013, death of Trevor Jay “TJ” Whiteside, according to prosecutors. Whiteside, 47, died from a heroin overdose, investigators said.

Prosecutors initially charged Averett with manslaughter, a second-degree felony, but agreed to reduce the charge to negligent homicide, a class A misdemeanor, in exchange for her plea.

The drug distribution charge was also reduced from a second-degree felony to a third-degree felony as part of the plea agreement, court records show.

Jaimez, 38, pleaded guilty in December to manslaughter, a third-degree felony, and distribution of a controlled substance, a second-degree felony.

A judge sentenced Jaimez to serve 300 days in jail or in an inpatient drug treatment program approved by Adult Probation & Parole. Jaimez was also ordered to serve 36 months probation and participate in substance abuse therapy.

The case against Mower, 37, is still pending. She is also charged with manslaughter and distribution of a controlled substance, second-degree felonies. Her preliminary hearing is set for March 24.

Averett is scheduled to be sentenced June 1.
