SALT LAKE CITY (AP) -- A federal judge says a former Brigham Young University swimmer injured while training can sue the school.
Rachael Ann Mason claims she suffered a permanent spinal injury while strength training as a member of BYU's varsity women's swim team. She filed a lawsuit, which BYU's attorneys wanted tossed.
In a ruling issued last week, U.S. District Judge Ted Stewart says the lawsuit won't have a chilling effect on college athletics.
Stewart says Mason has sufficient evidence to support her case and have it heard by a jury.
