LOGAN — The Utah Court of Appeals has overturned the 2007 sexual battery conviction of a Providence doctor and ordered a new trial.
Logan's Herald-Journal reports (http://bit.ly/MPrZJp ) the three-judge panel issued a split decision Thursday, five years after a jury convicted Raymond Bedell of the class-A misdemeanor charge for groping a patient in 2003.
He was sentenced to six days in jail and fined more $3,700.
The appellate court ruled that Bedell's attorney erred by not objecting to a line of questioning during trail that included testimony from a police detective about accusations from other women.
Cache County Attorney James Swink says his office will wait to decide whether to retry the case until the Utah attorney general decides whether to appeal the ruling to the Utah Supreme Court.
