PROVO, Utah (AP) -- A judge has agreed to appoint an attorney for Timmy Brent Olsen, who is charged with murder in the disappearance nearly 11 years ago of 15-year-old Kiplyn Davis.
Fourth District Judge Lynn Davis on Wednesday granted a request by Olsen, 28, to have a court-appointed attorney for the first-degree felony murder case. The attorney has not yet been selected.
The murder case is not expected to go forward until after Olsen's perjury trial scheduled for May 1 in U.S. District Court in Salt Lake City.
He is accused of lying to federal investigators about his knowledge of Davis' disappearance from Spanish Fork High School on May 2, 1995.
So far, federal prosecutors have not agreed to have him transported to Provo for proceedings in the murder case.
However, Davis scheduled a first hearing for Olsen on April 26 just in case federal officials change their minds.
