(KSL News) -- More details about an al Qaeda suspect who once lived in Utah.
We told you about Shawqi Omar Tuesday night. Omar is an American citizen, who attended Utah State for a semester, and lived here during the 80's.
NBC News discovered Omar is a detainee in Iraq, held for suspected connections to Osama bin Laden and Abu Musab al Zarqawi.
Bassam Omar, Brother of Shawqi Omar: "He is not a terrorist. It's all a big mistake and it's not fair to him or us."
Omar's attorneys are also questioning the constitutionality of their client's two year detainment.
They're asking the military to either charge him, or release him.
Susan Burke, Attorney for Shawki Omar: "Every United States citizen is entitled to a lawyer. And every United States citizen is entitled to know what it's government is claiming it did."
A judge blocked the federal government from transferring custody of Omar to the Iraqi government.
