Nishi Gupta reporting A 32-year-old man is rushed to the hospital after being hit by a car.

"I don't know if he was trying to cross the road, or if he just accidentally wandered into the road."

Police say the driver of an SUV in West Valley didn't see Samson Bates wandering into the road. Bates was flown to LDS hospital.

When police first arrived, he was already unconscious. Right now he's in critical condition. His injuries include broken bones and possibly brain damage.

Police say Bates was hit near the intersection of 5600 West and 4100 South.

They say they found two cans of spray paint and a wet plastic baggie, indicating he may have been high before he wandered onto the road.

They don't think the driver was at fault, so they have no plans to charge him. They don't think he was speeding or under the influence of any drugs or alcohol.

Sgt. John Rasmussen/ West Valley City Police Dept.: "The driver's a 22-year-old male, and was just drivig down the road. All of a sudden, this man appeared in front of him and he tried to stop but was not able to."

Police say it may have been difficult to see the pedestrian. Not only was it dark outside, but he was also wearing a dark coat and dark jeans.

They say it's likely Bates will undergo surgery soon.
