(KSL News) -- Attorneys for West Valley claim a man shot by police in July had both alcohol and methamphetamines in his system, causing him to him act irrationally.

The family of Bounmy Ousa is suing the city for more than one million dollars, claiming it is responsible for his death.

They say the officers knew Ousa was drinking vodka and that Ousa was not taking meth, but a legal herbal supplement with ephedra-like qualities. A toxicologist has been asked to confirm their assertions.

Both officers involved in the shooting were cleared of any wrongdoing.
