(KSL News) -- The man accused of kidnapping Elizabeth Smart is no closer to going to trial for crime.

Today the judge delayed the competency hearing for Brian Mitchell. Mitchell's first attorney resigned a while back and his new attorney needs more time to get up to speed.

It's also unclear if the media will be allowed into that trial. Two hearings are scheduled to deal with that issue. Mitchell and his wife, Wanda Barzee, are accused of kidnapping the teen on June 5, 2001.

A judge ruled Barzee is NOT competent to stand trial and she is receiving psychiatric care.
