(KSL TV) Brian David Mitchell, the man accused of kidnapping Elizabeth Smart, is allegedly resisting a court ordered mental competency evaluation.

According to this morning's Salt Lake Tribune, Mitchell has told his attorneys that he does not feel such an exam is necessary, and that he is reticent to share personal documents to make the evaluation possible.

Mitchell is accused of kidnapping Smart to make her his second wife after receiving a revelation from God.

Mitchell's wife Wanda Barzee is also charged in the case.
