PROVO — A Spanish Fork woman has been sentenced to prison for trying to find a hitman to kill her ex-husband in order to get custody of their children and a life insurance payout.

Billie Jo Agee, 46, was sentenced July 13 to up to five years in prison. She pleaded no contest last month to one count of criminal solicitation, a third-degree felony.

Agee was given credit for 107 days she has served in jail so far. Court documents note that the woman has "a significant mental illness."

In February, Agee "solicited her second estranged husband to kill her first ex-husband so she could get access to her children and obtain the proceeds of his $1 million life insurance policy," according to court documents.

Police have said no money ever changed hands in the deal, but Agee had been clear she wanted her ex-husband "out of the way."

Agee's criminal history in Utah includes a guilty plea to DUI in May 2016, according to court records. A child support lien case was filed against her on March 8 by the Utah Office of Recovery Services, court records show.
