SALT LAKE CITY (AP) — A judge has dismissed misdemeanor charges filed against two animal rights activists who were charged under an ordinance challenged by the American Civil Liberties Union of Utah.
Jeremy Beckham and Alexis Levitt were due to appear in court Monday, but instead the case against them was dismissed.
The charges said the pair didn't get a permit to protest living conditions for animals at Lagoon amusement park. The protesters and the ACLU argue that requirement violates the free speech rights and gives Farmington city officials too much power.
The city manager has said he suspended enforcement of the rule and will repeal any part deemed unconstitutional.
Prosecutor Troy Rawlings said when the suit was filed that the ordinance has constitutional problems and he planned to drop the charges.
