Utah woman sues airline for $1M

PROVO — A Utah County woman is suing US Airways after she claims the airline didn’t do enough to keep a drunken man from assaulting her.

The lawsuit stems from what reportedly happened on a flight from Phoenix to Salt Lake City in 2012. Attorneys for Amy Cutler say a man who appeared to be drunk asked to sit next to her.

Attorney Jake Hinkins said the man was red-faced and speaking loudly. During the flight, Hinkins said his client was extremely uncomfortable as the man made obscene gestures and talked about people he killed as part of a military organization in Africa.

Then, the man reportedly asked for more alcohol, Hinkins said.

“If an airline recognizes that someone is inebriated, they’re not to serve them alcohol," the attorney said. "That’s clearly the case here.”

Cutler claims she asked the steward not to serve the drink, but she was reportedly told she could not decide if someone else should be cut off.

The man was allegedly so drunk, he had trouble getting his wallet out of his pocket to pay for the drink. “He drank that and became louder and more intrusive to her," Hinkins said.

The man reportedly kept touching Cutler’s arm, trying to grab her hand. When the flight was almost over, Hinkins said his client was fondled over her clothing.

Now, she's suing for $1 million.

“We want this to be a wake-up call to US Airways," Hinkins said. "We don’t want something like this to happen.”

Officials from US Airways said they can’t comment on the lawsuit because the matter is still under investigation.
