OGDEN — A Roy man was sentenced Friday to at least 10 years and up to life in prison for sexual misconduct with two girls, a 10-year-old and a 14-year-old.
Second District Judge Cristina Ortega sentenced Gilberto Moises Rivera, 22, to a term of 10 years to life in prison for object rape of a child involving the younger girl, a first-degree felony, and a term of one to 15 years in prison in the Jan. 12, 2025, incident for burglary of a dwelling, a second-degree felony.
In the case involving the other girl, Ortega sentenced Rivera to a term of one to 15 years in prison for sexual exploitation of a minor, a second-degree felony, and zero to five years for dealing in materials harmful to a minor, a third-degree felony. The judge also sentenced him to a year in jail for unlawful sexual activity with a minor, a class A misdemeanor.
The sentences were ordered to be served concurrent with each other, and Rivera was given credit for time served.
Rivera entered the 10-year-old's South Ogden home about 5:30 a.m. on Jan. 12 last year without permission and started sexually assaulting her while she was asleep, according to court documents. He had been in prior communication with the girl's 17-year-old sister via social media and learned of their home address through her.
In the other case, the 14-year-old victim spoke to her mother about her connection with Rivera after learning of the incident involving the 10-year-old. The older girl said she and Rivera had had sex on several occasions over a six-month span.
In an interview with authorities, Rivera admitted he had sex with the girl several times, sent her nude images of himself and received nude images from her after asking for them, according to court documents.
In exchange for his guilty pleas, prosecutors agreed to dismiss charges of aggravated sexual abuse of a child, a first-degree felony, plus four counts of sexual exploitation of a minor, three counts of dealing in materials harmful to a minor and five counts of unlawful sexual activity with a minor, as part of a plea deal.
