Mary Richards reportingThe man who used pepper spray against a dog in Park City won't be charged.

Police say Bob Berube was justified in using pepper spray on the yellow Labrador, even though the dog wasn't attacking or even growling. Officers say you don't have to wait for that to occur to defend yourself.

Berube was walking along a trail in Park City when a woman came along with two dogs. He says he'd been bitten by a dog before, so that's why he pulled out the pepper spray.

Now police say the woman could be charged for having a loose dog.
