CHESAPEAKE, Va. (AP) -- A Circuit Court judge has denied a new trial for a Virginia man convicted of killing an LDS missionary in January 2006.
James Boughton Jr. sought a new trial, alleging juror misconduct during his three-week trial in Chesapeake in the shooting death of Morgan W. Young of Bountiful, Utah.
In December 2008, jurors convicted Boughton of killing Young with a gunshot to the head and wounding another missionary, Joshua Heidbrink of Greeley, Colo. The missionaries were shot while knocking on doors in the southeast Virginia city.
Boughton's attorney, Andrew Sachs, said Monday he intends to seek a new trial.
Jurors recommended a 38-year sentence for Boughton. Sentencing has not yet been set.
