(KSL News) Jeremy Hauck's attorney has filed a motion claiming the police who found the body of Hauck's mother in the basement of their Bountiful condo entered the house illegally.

The attorney argues police should never have entered the home because they didn't have a search warrant. However, police say they entered the home at the request of family members worried about Laura Hauck.

The motion asks for everything found during the August 7th search, including the body of the woman, be excluded from the trial.

According to the Deseret Morning News, a judge will hear the arguments at the end of this month. Hauck is currently in the Davis County Jail charged with first degree murder.
