OGDEN — A Pleasant View man was charged Tuesday with shooting three people during a fight, killing one man and critically injuring a second — his own brother.

Ricardo Caballero, 19, is charged in 2nd District Court with aggravated murder and discharge of firearm causing serious injury, first-degree felonies; discharge of a firearm with injury, a second-degree felony; and illegally firing a gun, a third-degree felony.

On Sunday, Ogden police responded to a report of shots fired and vehicles fleeing the scene in the 700 block of 30th Street.

"While officers were en route, dispatch received a phone call from a Ricardo Caballero. Ricardo reported that he was transporting his adult brother who had been shot in the hip to McKay-Dee Hospital," according to charging documents.

Officers found Caballero parked in front of the hospital with his brother in the passenger seat unconscious.

"Investigators observed a bleeding gunshot wound to his brother's left abdomen. His brother was admitted into the hospital in critical condition," the charges state.

As detectives sorted through what had happened, Caballero told them he had taken his brother to the area where the shots were reported because his brother had arranged to fight someone at that location, according to the charges. "Ricardo stated that unexpectedly, several other individuals also showed up at the scene of the fight."

After Caballero's brother and the other man began fighting, Caballero said a second man started walking toward them, apparently in an attempt to help the other man.

"Ricardo stated that none of the combatants, at any time, exhibited or threatened the use of a dangerous weapon or deadly force. Despite this, however, Ricardo stated he pulled out a 9mm handgun and began firing several shots toward (the two men) who were close to his brother," according to the charges. "Immediately, Ricardo heard his brother cry out in pain. At this point, he realized that he had shot his brother."

A second man also cried out in pain as Caballero allegedly continued shooting.

"Ricardo made several inconsistent statements throughout his interview. Among other statements, he stated that he shot toward an individual who was advancing toward him. Later, he stated that he actually shot toward the individual as the individual was trying to run away. And later, he stated that he actually only intended on firing 'warning shots' to attempt to scare the two individuals away from his brother," the charges allege.

Police went to the scene and located a deceased man who had been shot several times in the torso. His identity has not yet been released. Later, the man who Caballero's brother was originally fighting showed up at a local hospital with a gunshot wound to his hip, according to police.
