WEST VALLEY CITY — An argument between two friends ended in one fatally shooting the other early Tuesday morning.
Glen Clark Hogue, 58, was arrested for investigation of murder, despite repeatedly telling police "this was self-defense," according to a police affidavit, and that then gun "went off" twice.
West Valley police were called to 1504 W. Claybourne Ave. (2800 South) about 12:45 a.m. on a report of a person who had been shot, said police Lt. Bill Merritt. Officers arrived to find two men inside a motorhome parked in front of a residence.
Troy Gerry Frampton, 60, died at the scene as a result of his injuries, according to police.
Hogue and Frampton had known each other a long time, according to Merritt, and would often go into the motor home to drink. On Tuesday, the two were in the motor home drinking alcohol and smoking marijuana when Frampton allegedly showed Hogue his gun, according to a police affidavit. Hogue said he took the gun away from his friend.
"(Hogue) said he unloaded the gun and yelled at (Frampton) for bringing a loaded gun to his RV," the affidavit states. "He said (Frampton) tried to get the gun back from him and when he grabbed the gun, it went off accidentally into the floor."
Hogue told police the two men got into an argument for 15 to 20 minutes, the affidavit states. He claimed Frampton "was up and down," acting calm at one moment and belligerent the next as he tried to get his gun back, according to the affidavit.
"He said at one point, while (Frampton) was belligerent, he racked a round into the chamber and told (Frampton) to calm down, which he did again," the affidavit states.
Hogue told police that as his friend stood up to leave to wait outside the RV for an Uber, Frampton "attacked him" and punched him while Hogue was still holding the gun, according to the affidavit.
"He said as this happened, he pulled the gun up and 'it went off,' striking the (Frampton) in the chest. He said he knew it hit him in the chest but that the (Frampton) came after him again, swinging his fist towards him. He said he the gun 'went off' again he believed it struck or grazed the (friend) by the ear and up into the roof of the RV," the affidavit states.
Hogue then called 911.
"Hogue told dispatchers that a friend pulled out a gun and it was taken away from him. He stated that he shot the friend," the affidavit states.
West Valley police released a prepared statement Tuesday saying, "the evidence and information gathered through this investigation does not support the claim of self-defense."
