SALT LAKE CITY — A Springville man accused of attacking a couple at a TRAX platform and stealing a cellphone now faces criminal charges for a second time.
Since that attack, the couple was involved in a murder case.
Marcello Alfonso Martinez, 20, was originally charged in July with attacking Ryan Outlaw, 39, and Fernanda Tobar, 22, on July 3, according to charging documents. But the case was dismissed in September due to prosecutors not having the witnesses they needed to proceed, according to court records.
On Monday, charges against Martinez were refiled in 3rd District Court. He is charged with robbery and aggravated assault, second-degree felonies; failing to stop at the command of law enforcement, a class A misdemeanor; and criminal mischief, a class B misdemeanor.
Since the assault, however, the two victims were involved in their own violent incident. Tobar is charged with murder for stabbing Outlaw, her boyfriend, to death during an argument on Nov. 13.
In the July 3 attack, Outlaw and Tobar were stepping off a TRAX train at 350 W. South Temple when Martinez "jumped" Outlaw and knocked him out, according to charging documents. Two unidentified women who were with Martinez then took Outlaw's cellphone. Tobar was also hit on the head by Martinez while trying to help Outlaw and suffered injuries to her knees and elbow, the charges state.
Martinez was arrested at by UTA police at another TRAX platform.
In the November homicide case, Tobar is accused of stabbing Outlaw to death in an apartment complex at 239 E. South Temple. Tobar said they had been drinking and "that she was very angry and full of rage" due to jealousy issues between them, according to charging documents.
Tobar is scheduled to make her initial appearance in court on her murder charge on Dec. 14.
