SALT LAKE CITY (AP) — Federal prosecutors say Utah's first female police officer fatally shot on duty was killed because a Utah man refused to be arrested after selling methamphetamine.

Roberto Roman went on trial Monday for in the death of Deputy Josie Fox for the second time. He was charged with killing a law enforcement officer after a Utah jury acquitted him on aggravated murder charges.

The 44-year-old Roman says it wasn't him but the deputy's brother, Ryan Greathouse, who fired the fatal shots. He says they were in a car together when Fox stopped them. Prosecutors say that's not true.

Greathouse died shortly after Fox's 2010 death.

Roman's lawyer says his client plans to testify that he gave a false confession shortly after his arrest because he was afraid.

Prosecutors say he told the truth the first time.
