LENOIR, N.C. (AP) — Police say one man was fatally shot in an officer-involved shooting at a Walmart in northwest North Carolina. Two others are in custody, police in Lenoir say.

Police Chief Scott Brown said that 32-year-old Carl Marcus Nivins fired at police before one of the officers returned fire, killing him.

Brown said officers responded to a report of suspicious activity by Walmart employees. As officers approached, Nivins tried to flee before shooting at the officers.

Both Nivins and the officers were white, Brown said. Two others who were with Nivens were arrested on outstanding warrants for unrelated charges. The State Bureau of Investigation is looking into the shooting. The officers involved in the incident have been placed on administrative leave pending the investigation.
