OGDEN — A man already awaiting trial for murder has been charged with pulling a gun on another man at an Ogden pizza restaurant.
Jory Arlow Fenstermaker, 22, was charged Friday in 2nd District Court with aggravated assault, a third-degree felony, and disorderly conduct, a class C misdemeanor.
On July 17, Fenstermaker was at Lucky Slice Pizzeria, 200 25th St., when he got into an argument with a man inside, according to charging documents.
Fenstermaker and his group went outside the restaurant with the man, and Fenstermaker threw a slice of pizza at the man, the charges state. As the argument continued, Fenstermaker drew a gun from his pants pocket and pointed it at the man, the charges state.
Surveillance video shows Fenstermaker drawing his gun "and making the motion of racking the slide with his left hand," according to charging documents. When he was questioned by police, Fenstermaker claimed to have an airsoft gun, according to court documents.
The new charges come as Fenstermaker is free pending a trial in January on a murder charge.

On March 15, 2015, Fenstermaker claims he shot and killed Randy Lennell Lewis, 29, of Kansas City, Missouri, in self-defense following a night of drinking.
The two men were getting along well, according to witnesses, taking a selfie together, playfully "slap boxing," talking extensively and joking. The light mood soon changed, however, and the two had to be separated.
Fenstermaker claims Lewis threatened him with his life and was going for a kitchen knife when he shot him.
A final preconference trial for that case is scheduled for Oct. 20. Prosecutors filed a motion Monday to hold a hearing to have Fenstermaker's bail revoked based on the new charges.
