AUBURN, Maine (AP) — Maine prosecutors have dropped sex charges against a former education technician at Sacopee Valley High School who had been accused of sexually assaulting a 16-year-old student earlier this year.
The Lewiston Sun Journal reports (http://bit.ly/28Te1ba ) that charges of felony sex assault and misdemeanor sexual abuse against 24-year-old Zachariah Sherburne were dropped Friday.
Sherburne had pleaded not guilty on Wednesday and his lawyer moved to dismiss the charges, saying that Sherburne had left the school's employ before the sexual encounter took place.
Defense attorney Allan Lobozzo said Sherburne's last workday at the school was Feb. 11 and the sexual encounter occurred the following day.
Maine law says a 16-year-old may give consent for sexual relations, but it's illegal for a person in authority to engage in sexual conduct with a student.
