CALDWELL, Idaho (AP) — Three officers with the Caldwell Police Department have been cleared of wrongdoing in a Nov. 29 shooting.
The Owyhee County Prosecutor's Office has found the officers were in their bounds of authority to shoot Clifford Carter, 40, during a domestic disturbance call on Nov. 29, The Idaho Press-Tribune reported (http://bit.ly/1L7hENh ). He survived the shooting.
Nampa Police announced the decision about officers Joshua Gallup, Levi Glynn and Eric Phillips on Thursday.
Owyhee County Prosecuting Attorney Doug Emery said Gallup and Glynn fired their weapons during the incident. A total of 24 rounds were fired. Carter was struck twice in the shoulder and one round grazed his face.
Caldwell Police previously said Carter was shot when he attempted to flee police in his pickup and attempted to ram an officer with the vehicle and collided with a patrol car.
Officer Phillips stayed in his patrol vehicle during the incident.
Carter has pleaded not guilty to felony attempted strangulation, aggravated assault and domestic battery with traumatic injury in front of a child, misdemeanor driving under the influence, two counts of misdemeanor intentional destruction of a telecommunications device and two counts of misdemeanor malicious injury to property.
