SALT LAKE CITY — The case of a South Ogden tutor who investigators say had thousands of files depicting child pornography on his cellphone has been moved to federal court with a trial set for April.
Twenty counts of sexual exploitation of a minor, a second-degree felony, filed in state court against 25-year-old Jeremiah David Rivera were dismissed from 3rd District Court last month. A new federal indictment charges him with possession of child pornography.
Rivera, who identified himself online as the founder of a tutoring service called That Learning Place, was arrested in December after a co-worker picked up his apparently misplaced phone at work and, in searching the phone to try to discover who owned it, found child pornography.
A search warrant uncovered more than 2,000 images and 98 videos of child pornography, charges state. The phone also contained photos of Rivera and his family, text messages to his girlfriend and "emails from Rivera concerning employment related to child care," police said.
A jury trial in U.S. District Court has been set to begin April 4.
