TWIN FALLS, Idaho (AP) — A south-central Idaho man who authorities say took part in a plan to steal a car offered on Craigslist has pleaded not guilty to first-degree murder.
Jerry Burton Kimball, 22, of Twin Falls, pleaded not guilty Monday to first-degree murder and other charges in 5th District Court, the Times-News reported (http://bit.ly/1E0Ddvg ). A trial is set for Feb. 2.
Investigators say that on July 25, Kimball and Jacob Lyn Marshall, 20, met Kent Storrer, 53, and his son-in-law Jasper Qualls, 32, who had posted a Craigslist advertisement to sell a 1991 Mitsubishi 3000.
Court documents say that after the test drive, Marshall shot Qualls and Storrer with an assault weapon hidden in Kimball's car. Storrer was killed and Qualls was wounded.
Marshall and Kimball then drove off in the Mitsubishi, police said. Officers spotted the vehicle that evening in Jerome and arrested Marshall after a chase.
Kimball went to the police station the next day to provide information about the shooting and was arrested, police said. Kimball told police that he knew Marshall planned to steal the car and possibly kill someone, according to court documents.
The two men are charged with first-degree murder, conspiracy to commit first-degree murder, robbery, conspiracy to commit robbery, battery with the intent to commit a serious felony and conspiracy to commit battery with the intent to commit a serious felony.
Prosecutors have not said whether they will seek the death penalty.
Marshall declined to enter a plea in court last week. A judge entered a not guilty plea for him. He's scheduled for a Nov. 21 pretrial conference and a Jan. 11 trial.
The two suspects were being held without bail.
