SALT LAKE CITY (AP) -- A judge has denied a request by the Salt Lake Legal Defenders Association to remove the group's attorneys from the case of an inmate charged with killing a prison guard while escaping last summer.
The defenders' association filed a motion to remove attorneys from representing Curtis Allgier because of several ties between the office and guard Stephen Anderson, who was killed while escorting Allgier at a medical examination on June 25, 2007.
Judge Deno Himonas denied the request, but did allow defense attorney Michael Peterson to be replaced by Michael Mack.
Allgier, 28, is charged with capital murder in the shooting of Anderson, a 60-year-old state corrections officer who had transported Allgier from the state prison to University Hospital for an MRI.
Allgier is scheduled for a preliminary hearing July 11. Prosecutors plan to seek the death penalty if he is convicted.
