CLEVELAND (AP) — A federal judge will hold a hearing next month to determine whether to delay the lawsuit filed by relatives of a 12-year-old boy fatally shot by Cleveland police while the criminal investigation is pending.
Tamir Rice had an airsoft gun that shoots nonlethal plastic pellets when an officer shot him outside a Cleveland recreation center last November.
The officers involved asked a judge to delay the family's lawsuit until the investigation is completed and considered in court. The family's attorneys have objected to that.
The Northeast Ohio Media Group reports (http://bit.ly/1cMy8dh ) a federal judge in Cleveland will hold a hearing June 1 to decide whether to put the lawsuit on hold.
Cuyahoga (ky-uh-HOH'-guh) County Sheriff Clifford Pinkney said last week that detectives have completed most of their investigation into the shooting.
