LOS ANGELES (AP) — Safeway says it has pulled prepackaged caramel apples from its shelves.

The statement Tuesday came a day after the family of a person who died from a listeria infection linked to the fruit sued the grocery company.

The lawsuit says Shirlee Jean Frey became ill after buying several caramel apples from a Safeway supermarket in October.

The Centers for Disease Control and Prevention confirmed the 81-year-old woman was sickened with the same strains of listeria found in apples that infected 28 other people in nine states.

Brian Dowling, a Safeway vice president, said the apples were supplied by a third party, and the chain was previously unaware of any issue relating to the sale of the product.

Health officials urged anyone with commercially produced, prepackaged caramel apples to throw them away.
