BOISE, Idaho (AP) — Middleton's mayor says a city councilman accused of having a sexual relationship with a minor will remain on the council while his felony case is pending.

Mayor Darin Taylor said in a statement Friday the facts aren't known and individuals are innocent until proven guilty. Taylor says he does not believe the accusations will affect Councilman Bradley Spencer's ability to perform his duties.

Spencer was arrested Thursday night on a charge of sexual battery of a minor 16 to 17 years old.

The Idaho Statesman reports (http://bit.ly/1nCQtsb ) the 56-year-old grandfather told investigators he was in a relationship with the girl and they had been having sexual contact since June.

The city's website says Spencer and his wife have six children and three grandchildren.
