(KSL News) The former commander of the Utah Highway Patrol's DUI enforcement team is appealing his own drunken driving conviction.
Fred Swain pleaded guilty to a charge of alcohol related reckless driving in Draper City Justice Court earlier this year and was sentenced to one year probation and a $782 fine.
However, now he is appealing the conviction to the 3rd District Court and asked that his sentence be stayed until that case is completed.
The Draper City judge denied that request.
