Brothers plead guilty in June 2011 killing

VERNAL — Two more people have pleaded guilty to reduced charges in connection with the June 2011 shooting death of a Roosevelt man.

Kevin Silva and his younger brother, Alberto Silva Jr., pleaded guilty Wednesday in 8th District Court to aggravated assault, a second-degree felony, attempted aggravated assault, a third-degree felony, assault, a class A misdemeanor, and committing a violent act in the presence of a child, a class B misdemeanor.

The Duchesne County men were initially charged with murder and attempted murder, both first-degree felonies, as well as three counts of aggravated assault, a second-degree felony, and three counts of committing a violent act in the presence of a child, a class B misdemeanor.

With their pleas the brothers became the fourth and fifth defendants to admit that they played a role in the June 28, 2011, slaying of James Edward Carey, 25, and wounding of Jared R. Hurley, 35. Two other individuals are still facing murder charges in the case.

Uintah County sheriff's detectives say Bruce Silva, 24, was upset because someone had vandalized his car. He took a group of people that included his girlfriend Shadow Reed, three of his brothers, another man and two women to a home to confront the individuals he believed were responsible.

Bruce Silva had given Colin Rian Manning a handgun prior to going to the home, according to detectives, and demanded the weapon back from Manning when the confrontation escalated. He then fired multiple shots, striking Carey in the head at least once.

After the shooting, Silva, Reed, Manning and Teaunna Cesspooch fled the Uintah Basin. Silva, who is a U.S. citizen, was later arrested in Tijuana, Mexico. The other three were arrested on the Wasatch Front.

Bruce Silva pleaded guilty in May to murder and aggravated assault and was sentenced to 15 years to life in prison and a consecutive one-to-15-year term.

Reed and Adrian Silva both pleaded guilty in September to reduced charges of aggravated assault and committing a violent offense in the presence of a child.

Cesspooch, 20, is the lone defendant with a pending case in state court. She is charged with murder and attempted murder, both first-degree felonies, as well as three counts of aggravated assault, a second-degree felony, possession of a dangerous weapon by a restricted person, a second-degree felony, and three counts of committing a violent offense in the presence of a child, a class B misdemeanor.

Cesspooch is currently undergoing an evaluation to determine whether she is competent to stand trial.

The charges against Manning, 25, were filed in federal court because he is an enrolled member of an American Indian tribe, and the shooting occurred within the boundaries of the Uintah-Ouray Indian Reservation.

Manning is scheduled to go on trial Oct. 22 on charges of murder in the second degree while within Indian Country, assault causing serious bodily injury while within Indian Country, and use of a firearm in furtherance of a crime of violence.

Reed, 24, is slated to be sentenced Oct. 23. A sentencing hearing for Adrian Silva, 24, is scheduled for Nov. 4. Kevin Silva, 21, and Alberto Silva Jr., 20, are set to be sentenced Dec. 4.
